In most places, it's legal to own a skeleton key, but using it to unlock something without permission is illegal.
It really depends on age, condition and, mostly, rarity. A rusted to bits 4,500 year old iron & wood key is worth quite a lot, while a 4.5 year old today steel key in perfect condition is likely worthless.
A few keys are stamped with a date, but this is uncommon. Most skeleton keys you find in old drawers and boxes in your attic are from before 1940, but some keys can be very old. Look to see if the shape appears uniform or hand-molded. Handmade keys are typically older than manufactured ones.

Genuine antique skeleton keys are quite collectible, although their value varies greatly, depending upon their age, scarcity, embellishments or details, their weight, shape, and size.
Little changed in the design of the mechanism until the mid 1800's when Linus Yale Sr. and Jr. introduced the modern flat keys. Skeleton keys, however, continued to be used in most houses until after WWII when the pin tumbler lock (or Yale lock) took over.

Once you know what you are feeling around for in a skeleton key lock, it should not take you very long to pick it. Whether you are into antiques and came across a trunk that you cannot get open or you lost the key to an old door, you should be able to undo that lock with two allen wrenches and a little bit of patience.

The Crucifix, the Skeleton Key and the Shears items were found to be deleted before the game's release. The reason for their deletion is unknown, however it is possible that their useful functions were considered too extreme for the state of the game at the time.
