Today, there are no exceptions that allow for such additions. Title 40 says that a person operating or maintaining an AC or heat pump cannot vent refrigerant. If you have a leak, and add more refrigerant to the system, the refrigerant will eventually escape through the leak unless a technician repairs the leak.
The New Regulations
Starting January 1, 2025, all new residential air conditioners and heat pumps must utilize A2L refrigerants. Older refrigerants like R-410, which are likely the refrigerant used by your current system, are being phased out.

New EPA Refrigerant Regulations 2025
In 2025, the goal is to eliminate all refrigerants with a high Global Warming Potential. In practice, this means that all new AC units must use refrigerants with a GWP rating of 750 or less.
R134a is not an ozone-destroying agent, but it is a greenhouse gas, and is illegal to vent as well.
So, what happens if you do just add refrigerant to a leaking AC system, or don't get it fixed once the leak is reported? The EPA will fine you. There is no way to sugarcoat this. The fine can be as high as $37,500 per day.
Under Section 608 of the Clean Air Act, EPA prohibits individuals from knowingly venting refrigerants containing ozone-depleting refrigerants (including HCFC-22) as well as their substitutes (such as HFCs, including R-410A), while maintaining, servicing, repairing, or disposing of AC and refrigeration equipment.

A Question of Supply and Demand
Even though Freon is still being produced, the supply has dwindled as producers have cut back in anticipation of lower demand. Therefore, maintenance people and air conditioning system specialists have less supply and are charging more for it.
One of the most obvious signs that your vehicle needs a Freon recharge is that your vehicle will be blowing warm air, even after your vehicle has been running for some time. If your refrigerant gets too low, there will simply not be enough “coolant” to cool the air as it is passed through your evaporator coil.

If a technician purposely vents these refrigerants, they are subject to fines and criminal prosecution. As of 2017, penalties for venting include a fine of up to $44,539 per day per violation. For example, this means that with two violations over three days, you can be fined up to $267,234!
